一、培养目标

以法学学科为基础,发挥上海的地缘优势,培养具备良好的基本素质和专业素养、具有国际视野和良好的法律职业操守、精通商事金融等领域知识,系统掌握法律专业知识的,具有创新创业思维的高层次法商融合型、应用型法律人才。

二、学制

采用全日制学习方式,学制为3年。

在规定时期完成课程学习,但未完成学位论文者,可申请延长学习年限,延长的学习年限累计不超过2年。

三、专业方向

法律硕士专业通过法律实务选修课方式确定法律实务领域的不同专业方向。具体见附表。

法律实务的专业领域方向,按照法律职业和相关行业法律实践的需求设置,是为了法律硕士研究生熟练掌握某个专门法律领域的知识和职业技能,具备和强化在特定行业领域内的法律实务能力。四、课程设置与学分要求

法律硕士专业学位研究生毕业并获得学位,总学分不低于71学分。(该总学分不包括学位论文的5学分。)

课程设置及学分:学位基础课程33学分,选修课程21学分,实践训练课程15学分,学位论文5学分,名师讲座2学分。具体见附表。

五、培养方式

采取本校具有实务经验的教师和校外实务导师共同指导的“双导师制”。

法律实务方面的专业方向课程、法律实务专业选修课程、法律实践训练课程,由具有教学能力的法律职业人士/本校具有实务经验的教师担任。

法律专业课程不少于四分之一的案例教学内容。所有课程教学注重教材或教学资料的课外阅读(课前预习和课后练习)。

采用多途径的课堂教学和实践教学相结合的培养方式,着重培养学生符合法治发展方向、适应法律职业需求并且经过强化的实践能力。实习实践原则上从第四学期开始,如在第四学期之前完成论文初稿并经过导师同意的,可以提前实习。

六、科研要求

在校期间应当积极参加校内外导师主持的科研项目、法律实务研究项目,参加校内外相关的专题讲座和学术沙龙,提高理论与实践相结合的实务与应用能力。具体科研要求参见《纽约国际588888线路检测中心研究生教育管理办法》及《纽约国际588888线路检测中心研究生培养管理办法实施细则》。

七、学位论文与学位授予

 学位论文需贯彻理论联系实际的原则,以法律实务研究为主要内容、突出问题意识,形式上主要为专题研究、调研报告、案例分析等。

学位论文一般不少于2万字。学位论文的具体写作要求参见《上海市法律硕士专业学位论文基本要求和评价指标体系(试行)》。

修满规定的学分且各课程考试合格者可参加学位论文答辩。通过学位论文答辩者,授予法律硕士专业学位,并颁发学位证书。

I.Cultivation Objectives

Byrelying on the disciplinary resource of subjects of science of lawand utilizing the geographic advantage of Shanghai, we aim atcultivating high-level, practice-oriented professionals who willharbor professional ethics and a good command of global financialpractice and legal expertise, full of ideas of innovation, and ableto master the knowledge of both law and commerce.


II.Cultivation Duration

Wecarry out full-time learning, and the duration is two year and ahalf.

Studentswho complete the prescribed courses but do not complete thedissertation may apply for an extension of the learning period. Themaxim extension period is two years.


III.Specialty Directions

JurisMaster Center has set up selective specialty courses, as listed inthe Annex, for postgraduates to choose.

Thespecialty courses are established by virtue of the market needs oflegal profession and related trades with the goal of strengtheningpostgraduates’ law practicing ability and mastery of knowledge andprofessional skills in specific areas of law.


IV.Curriculum and credits

JMStudents must obtain no less than 73 credits to be eligible forgraduation and diploma.

73credits consist of 6 credits for commonrequired courses, 32 credits for degree course, 13 credits forselectivecourses, 8 credits for law-practicing courses, and 5 credits fordissertation. The Detailed explanationis set out in the Annex.


V.Cultivation Method

Two-trackmentor system which consists of on-campus professors with practicalexperience and off-campus mentors with practical expertise is appliedto postgraduates immediately after their enrollment.

Eachspecialty selective course will be taught by committee consists ofon-campus professors with practical experience and off-campus mentorswith practical expertise and is responsible for designing anddirecting the curriculum teaching and management, and professioncultivation of postgraduates.

Thespecialty courses and practices courses are undertaken by competentoff-campus legal professionals and/or on-campus professors withpractical experience.

Atleast 1/4 of each legal course shall be case study. Student’soff-class reading, both prior to and after class, of textbook andteaching materials shall be prompted in teaching.

Thefocal point of our education is to cultivate talents is compatiblewith development of rules of law and market demand for legalprofessional, and possess strengthened law-practicing ability andskill.


VI.Requirements for Academic Achievements

Forthe purposes of fostering academic research skills of combiningtheory with practice, the student in this major should activelyparticipate in various research projects guided by supervisors of thelaw school, as well as lectures and academic seminar.


VII.Dissertation and Award of Degree

Thesisshall research on practical issues, following a question orientsapproach and combining theory with practice. Thesis should take theform of case study, research report, or case analysis.

Themain body of the thesis should be no less than 20,000 words. Forspecific requirements for the thesis, please see the Thesis FormatRequirements of the Shanghai University of International Business andEconomics for Master Degree Students (Draft).

Thestudents who secure the required credits and pass all theexaminations may proceed with oral defense for thesis. Once passedthe oral defense, the students will be awarded the JM Degree.
